Members are reminded that there are currently no age restrictions on the sale of any caffeine containing foods and beverages, including energy drinks.
Under 16 year olds do not legally need to provide an ID to buy an energy drink, although there is an industry agreement to not promote to that age group.
There are also no legal limits on the amount of any caffeine containing food or beverage drinks that someone can purchase in one transaction.
Retailers may choose to restrict sale to those over a specified age (e.g. 16) and this policy can be used alongside a ‘challenge’ scheme, like Challenge 25.
Energy drinks cannot be age restricted for individuals over the age of 18 years old.
