Members who are selling any Vapeman products are told to remove them from their shelves immediately. The MHRA has instructed the manufacturer of Vapeman branded products to withdraw all products from sale in Britain.
The Independent British Vape Trade Association (IBVTA) says the manufacturer has not completed the notification process and therefore the products are deemed “unnotified” and must not be offered for sale.
If retailers cannot find a product on the MHRA’s website, then they should ask their supplier to confirm that it has been published and provide details to confirm the products status. If a product has yet to achieve publication status, they must not supply it, and it is illegal for retailers to offer it for sale.
The Association suggests if retailers are selling Vapeman branded products in store or on their websites, they are legally required to:
- Remove all Vapeman products from sale immediately.
- Seek assistance from your supplier regarding disposal/return of the products. Report any lack of assistance to your local Trading Standards office, including copies of all correspondence and invoices.
It further warns: “Trading Standards officers may carry out compliance visits to premises they suspect of selling Vapeman branded products.
“A business found to have Vapeman products for sale will have the products seized and enforcement action considered. This enforcement action can include prosecution.”
